1. Preamble

These Terms & Conditions of Sale (hereinafter “T&Cs”) govern all commercial relations between SINA, operating the website Madame’s Home (hereinafter “the Seller”), and any adult natural person, non-merchant (hereinafter “the Customer”), making a purchase on the website madameshome.fr.

Any order placed on the website implies the full acceptance of these T&Cs by the Customer. The Seller reserves the right to modify the T&Cs at any time; the applicable T&Cs are those in force at the date of the order.

3. Scope and acceptance

These T&Cs apply to any distance sale concluded via madameshome.fr between the Seller and a consumer. Order validation by the Customer constitutes unreserved acceptance of these T&Cs. The Customer acknowledges having read the T&Cs before order validation.

4. Products

The Seller offers tableware, kitchen items and home décor for sale. Products are presented with their essential characteristics: visuals, dimensions, materials, care instructions and prices.

Photographs and descriptions are indicative and do not commit the Seller regarding minor variations in tones or finishes inherent to the artisanal nature of some products. Products are offered subject to stock availability; in case of unavailability after order, the Customer will be informed as soon as possible and refunded in full where applicable.

5. Prices

Prices displayed on the website are in euros (€), all taxes included, excluding shipping costs. Shipping costs are specified before order validation and invoiced in addition, unless otherwise stated (free shipping above a purchase amount displayed on the homepage and at checkout).

6. Orders

The Customer places an order by following the steps displayed on the website: product selection, basket, summary review, identification (or account creation), choice of delivery method, choice of payment method, acceptance of these T&Cs, final validation and payment.

The order is definitively validated after payment confirmation. A confirmation email summarising the essential elements (order number, products, price, delivery) is sent to the Customer at the provided email address.

7. Payment

Payment is made, at the Customer’s choice, by credit card (Visa, Mastercard, American Express) via 3D Secure, PayPal, Apple Pay or Google Pay. Bank transfer is available on request for orders over €500. All payments are encrypted; no banking data is stored by the Seller.

8. Delivery

Orders are shipped within 48 business hours from payment confirmation. Standard delivery times: mainland France 3-5 business days; European Union, UK, Switzerland 5-10 business days; outside EU on a per-quote basis.

Free shipping in mainland France above a purchase amount specified on the website. Customs duties for non-EU shipments are charged to the recipient.

The Customer must check the condition of parcels upon delivery. In case of apparent damage or missing items, precise reservations must be issued on the carrier’s delivery slip and the Seller contacted within 3 days at contact@madameshome.fr.

9. Right of withdrawal

Under article L.221-18 of the French Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from receipt of the products, without justification.

As a commercial gesture, the Seller extends this period to thirty (30) calendar days.

To exercise this right, the Customer notifies the decision by email at contact@madameshome.fr with the order number and the products concerned. Products must be returned in their original packaging, unused and in perfect condition, within 14 days of notification. Return costs are at the Customer’s expense. Refund issued within 14 days of receipt of returned products.

10. Legal guarantees

The Customer benefits from the French legal guarantee of conformity (2 years from delivery, art. L.217-3 of the Consumer Code) and the guarantee against hidden defects (2 years from discovery, art. 1641 of the Civil Code).

11. Customer service and complaints

Any complaint may be sent by email to contact@madameshome.fr. The Seller commits to respond within 5 business days.

12. Consumer mediation

In case of unresolved dispute, the Customer may use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

13. Personal data

Personal data is processed in compliance with the GDPR. See our Privacy Policy.

14. Intellectual property

All elements of the website (texts, images, videos, trademarks, logos, structure, code) are protected by copyright and trademark law. Any unauthorised reproduction is strictly prohibited.

15. Force majeure

The Seller cannot be held liable for any delay or failure resulting from a force majeure event as defined under French law.

16. Governing law and jurisdiction

These T&Cs are governed by French law. In case of dispute, after attempted amicable resolution, French courts shall have sole jurisdiction. Consumer Customers may bring the case before the court of their domicile or that of the Seller’s registered office (Chambéry).
